Draft law on the use of artificial intelligence in migration management

A new draft law aims a legally secure and data protection-compliant use of AI in migration management in order to make administrative procedures relating to asylum and residence law more efficient, uniform, high-quality and safer. The draft law establishes the legal basis for the processing of personal data for the development, for the training, validation and testing of Al systems or other automated applications for data processing by the authorities entrusted with the Asylum and Residence Act.

Furthermore, the draft law provides for the possibility of using an automated application for data processing to carry out automated process monitoring, which serves for analysing the process of procedures and decision to identify structural patterns, possibilities for accelerating processes and optimization needs.

In addition, there is the possibility to verify individual application details with an automated comparison with publicly available internet data, if there are reasonable doubts as to their accuracy and the comparison is necessary to clarify these doubts.
