Federal Cabinet approves draft law for designation of safe countries of origin by ordinance

On 4 June 2025, the Federal Cabinet approved a draft bill that will allow safe countries of origin to be designated by an ordinance. The draft bill will be made available to the governing coalitions as a formulation aid.

The draft bill foresees to remove the mandatory appointment of a legal representative in cases of pending return procedures. The court which decides on the detention order will continue to be obliged to appoint a lawyer at the request of the person if the factual and legal situation is difficult.
