Draft law to establish a dedicated asylum and immigration court does not receive unanimous support in Justice Committee

Draft Law No. 8694, providing for the creation of a specialised asylum and immigration court by 2027, did not receive unanimous support when presented to the Justice Committee on 4 June 2026.

Under the draft law, the proposed judicial body would take the form of a specialised section within the Administrative Tribunal, with exclusive jurisdiction, rather than an independent court. Some opposition MPs argued that establishing a separate court could offer advantages, particularly in terms of judicial recruitment, although this would require a constitutional amendment. Others supported the proposed approach, which would allow a specialised section to be established more quickly to handle the anticipated increase in workload.

Certain provisions are expected to enter into force on 16 September 2026 to allow recruitment to begin, while the specialised section is scheduled to become operational on 16 September 2027.

The Justice Committee adopted several amendments by majority vote and will continue its work through discussions with representatives of the judiciary.
