The Supreme Administrative Court restores access to housing for all minors, beneficiaries of temporary protection in Bulgaria

The Foundation for Access to Rights informed that the Supreme Administrative Court annulled, by a final decision adopted in a five-member panel, two provisions of the Council of Ministers’ Decision 278/02.05.2025 on a Programme for Humanitarian Support and Integration of Displaced Persons from Ukraine with Temporary Protection. 

The court found that the contested provisions infringed Articles 3 and 27(3) of the UN Convention on the Rights of the Child and Article 8 of the ECHR because they discriminated against children based on age for access to housing and unjustifiably restricted cohabitation with both parents, thus violating the best interests of the child.
