A new draft law aims to legally secure and put in place a data protection-compliant use of AI in migration management in order to make administrative procedures relating to asylum and residence law more efficient, uniform, of higher quality and safer. The draft law establishes the legal basis for the processing of personal data for the development, training, validation and testing of Al systems or other automated applications for data processing by the authorities entrusted with the Asylum and Residence Act.
The draft law provides for the possibility of using an automated application for data processing to carry out automated process monitoring, which analyses procedures and decisions to identify structural patterns, possibilities for accelerating processes and optimisation needs.
In addition, It is possible to verify individual application details with an automated comparison with publicly-available data, if there are reasonable doubts about their accuracy and the comparison is necessary to clarify the doubts.
