UN Committee on the Rights of the Child rules in a 2019 case of illegal detention and inadequate age assessment

On 14 September 2026, the UN Committee on the Rights of the Child ruled that two applicants who were detained in Czechia in 2019 were held in illegal detention and not provided adequate age assessments, depriving them of special guarantees for children. The committee held that the authorities should take all necessary measures to ensure that children are not deprived of their liberty due to their or their parents’ migration status, non-custodial solutions are available to preserve family unity and when there is reasonable doubt about a person’s age, a prompt, child-sensitive and culturally appropriate age assessment is conducted, with the benefit of the doubt and the presumption of minority applied pending its outcome.
