Austria no longer applies automatic temporary protection status for military-aged men from Ukraine

The Austrian government has approved an amendment to the Displaced Persons Regulation, implementing changes on EU-level on temporary protection for people displaced from Ukraine. Temporary protection for displaced persons will be extended by another year until 4 March 2028.

Under the new rules, newly arriving Ukrainian nationals will receive residence rights as displaced persons only if they have fulfilled their military obligations under Ukrainian law or are exempt from them. Relevant proof must be provided if required. The new rule applies to new arrivals from the beginning of August 2026.

Furthermore, a displaced person who is already receiving temporary protection in another EU member state will not be granted residence rights for displaced persons in Austria.
